After much waiting, you finally officially obtain your ITIN from the IRS. But did you know that you need to keep using it or it will expire? Yes, that’s correct. ITINs expire after 3 consecutive tax years of non-use.
ITIN renewals
ITINs expire on the 31st of the 3rd consecutive year of non-use. For example, a foreign person living in another country earns US-based income from an inheritance, but doesn’t file a return after a few years, the ITIN expires. A new W-7 form will need to be submitted to renew. Filing an income tax return with an expired ITIN may cause delays in processing a return. Additionally, you may not be able to claim certain credits, such as some dependent credits, until that ITIN is renewed.
Form W-7 ITIN applications are used to renew ITINs. W-7s must be filled out completely and “Application type” section needs to be indicated as a renewal of the ITIN. Any name changes, such as through marriages or court orders, must have proper supporting documentation submitted with the W-7.
